·06 july 2011 6/24/11 4:28 pm page 1 6 beach metro news july 2011 in my opinion trustee s ordeal is over case dismissed it s over i yelled i was being sued for conflict of interest because i have a daughter who teaches in the tdsb and it is over the complaint had been withdrawn and the judge had dismissed the case it isn t as satisfying as being found innocent but it will cost less than a fifth of a trial and most importantly it is over for those of you who have never been sued let me tell you it is scary and destabilizing no matter how firmly you believe in your own innocence it began with the serving of the notice on the friday before last year s municipal election my first task after trying to figure out trustee toronto district school board sheila cary-meagher what had just happened was to find someone who could tell me what i needed to do find a lawyer get documents asked for in the writ clear the use of the documents with the relevant parties then going over the documents to try to recall all of the personal information such as emails and conversations the who-was-doingwhat-to-whom-and-when information going back seven years and hardest of all find the money to pay the lawyer i have a daughter my third who is a teacher in the tdsb she has been with the tdsb for more than 11 years and for the tcdsb for quite a time before that that makes her pretty far up on the seniority list more than half of the secondary teachers in toronto would have to be fired before her job would be in danger i have been scrupulous in declaring that i might be perceived to have a conflict of interest and abstaining from debate not discussing anything to do with negotiations and withdrawing from the room when items on teacher salaries or positions are discussed i know that my job would be on the line if i were to participate in anything to do with these topics what will happen now is that i must apply to be reimbursed for the funds spent in my defence this is covered by board insurance against frivolous and vexatious suits it seems that large corporations carry such insurance to protect against just such occasions as this because of this i had wanted to publish this article in beach metro before the regular press had the information i may have been too late and it may have gotten to you in one of our city s papers if so i am sorry i really wanted you to be the first to hear about and for it to have come from me personally were i found guilty of a conflict of interest i could well lose my position as trustee i am sure that you are all aware that i love this job and would never do anything to endanger it or to lose the trust of the people i serve to guide and protect the tens of thousands of children of this board is an awesome challenge and opportunity i take it very seriously finally i want to thank all of the folks who have given advice and support it really mattered i won t soon forget beach metro community news published by ward 9 want more of them in response to the may 17 2011 column by thomas neal `hug a tree it s making you richer i enjoyed tom s column and his insight into the monetary value of residential street trees on homeowners properties naturally this can be a significant contributing factor to one s purchasing choice what i would like to add are some important aspects that go beyond the real estate value tom mentioned a study showing each mature tree increased property value by $10,000 to $15,000 a mature deciduous tree on the south or west of a house can also reduce your energy bill for air-conditioning by up to 40 and evergreens planted on the north act as windbreaks lowering winter heating costs by up to 10 the only way future energy costs are going to go is up so you do the math secondly aside from the tree canopy s pleasant cooling effect in summer easily 2-4c° cooler underneath it provides important air filtration i bet each of us knows more than one person with breathing problems with all the carbon dioxide dust and other air pollutants that a city s daily activities spew out we can do with all the help we can get we have several options to maintain our tree canopy for the future home-owners can order a free frontyard tree from the city toronto.ca/trees/pdfs/freetree_final.pdf or a subsidised backyard tree from leaf yourleaf.org/toronto to make a bigger impact streets or blocks can mobilise their neighbours for a bulk tree order our councillor mcmahon s new community work groups include `greening ward 32 teams working on beautification and ecospark s live green toronto community animators can help pull together information tips and resources toronto.ca/animators and to show that community power works a leslieville riverdale tree project this year exceeded their goal of 150 new residential trees and now aims to get another 200 for a total of 450 other such initiatives davenport-perth 165 trees and harbord village 150 trees even on a much smaller scale mobilising maybe 30-50 homeowners to say yes to a new free tree shouldn t be so hard should it while tom said hug a tree i say plant a tree martina rowley live green toronto community animator southand member of greening ward 32 re `hug a tree it s making you richer last year i made a nice little flowerbed outside my window and this year i have about 70 silver birch seedlings growing up on their own from the seeds of a nearby large birch tree birch trees are native to ontario and grow well in this area as is reflected in names like silver birch birchmount and birchcliff the parent birch tree outside my window attracts many birds such as downy woodpeckers yellow-bellied sapsuckers white and red-breasted nuthatches brown creepers blue jays cardinals and magnolia and nashville warblers what i have discovered is that if you leave even a small space for the seeds nature spontaneously continues its flow of life the oaks to which mr neal refers will continue if enough spaces are left for the squirrels to plant their acorns lorna houston norway avenue that adorns the kew beach public school fence each child in the school hand painted a fish as part of a community eco-education awareness project for earth day in april the fish took weeks to paint and it took a lot of co-ordination by volunteers teachers and community donators in the end though all the hard work was worth it because the children were so proud of their effort parent volunteers gladly worked hard putting up all 450 fish by hand in the cold spring rain arranging them in artful dips and waves my six-year-old son was so proud of his fish that he brought all our family to see it even passers-by could not escape his enthusiasm as he pointed to his master piece a month and a half later my son still likes to run to his fish on the way to school and makes a game of finding his friend s fish too kew beach public school prides cont d on page 38 fishy vandalism you probably noticed the ·11 july 2011 6/24/11 12:26 pm page 1 july 2011 beach metro news 11 money life and law learn the options for inheriting a rrif ever wondered what the difference is between a `successor annuitant and a named `beneficiary designation when transferring from a registered retirement savings plan to a registered retirement income fund probably not but the distinction is important a rrsp registered retirement savings plan is a tax deferred savings plan to save for your retirement at age 71 rrsps must be transferred to a rrif registered retirement income fund with a minimum mandatory income payout each year at the time of setting up the rrif you may select on the application form or in your will to have your spouse or common law partner named a successor annuitant or a named beneficiary of your rrif in the event your spouse predeceases you don t forget to elect a beneficiary or a contingent beneficiary to receive the proceeds of your rrif imagine the following barney and betty have been married since 1976 together they have purchased a home contributed to their rrsps and spousal rrsps paid into company pension plans raised one child and finally retired in 2007 during retirement the grandchildren have come to live with barney and betty and are fully supported by them this year they will have to transfer their rrsps and spousal rrsps to rrifs they are both concerned what is the best option for them successor annuitant or named beneficiary again barney and betty imagine in their imagination barney has been deceased for three months what is the situation if they had elected successor annuitant · betty continues to receive income from her pension cpp canada pension plan oas old age security and her rrif ·since she and barney owned their j mcpherson cfp clu tep providing consultations to individuals in planning their financial lifestyles 416-738-1555 home jointly there is no change · she has applied to receive the spousal benefits from barney s cpp and company pension but is still waiting to receive them · since barney selected betty as successor annuitant for their rrifs betty has informed the applicable financial institution and provided them with a death certificate betty is now the owner of barney s rrif and the income continues to betty uninterrupted · any income from barney s rrif up to the point of his death is reported on his terminal tax return a.k.a final tax return · even more importantly the fmv fair market value of barney s rrif is not reported as income for income tax purposes · further if betty was under age 71 she could have transferred barney s rrif to her rrsp once more they imagine the future this time both barney and betty are deceased betty opted for a named beneficiary for her rrifs her beneficiary is her estate · betty has named qualified beneficiaries a child or grandchild who is financially dependent on the deceased in her will to receive the rrif proceeds the grandchildren are under the age of 18 and their net income is under the basic personal amount of $10,382 2010 note if the named beneficiary was infirm financially dependent and qualified for the disability amount the net income to qualify as dependent would increase to $17,621 2010 · since the grandchildren are under the age of 18 betty has directed in her will the rrif be used to purchase annuity monthly income until they are age 18 and a lump sum to be invested for the grandchildren s education over age 18 · the lump sum amount invested for the grandchildren will be taxed on the children s tax return in the year of betty s death · the annuity monthly income has the tax advantage of being taxable in the year of receipt thereby spreading the tax over a period of years until the grandchildren are age 18 · in the event betty did not have any qualified beneficiaries the full fmv fair market value of her rrif would be reported on betty s terminal tax return a.k.a final tax return and any income earned between the date of death and the winding up of her rrif would be taxable to her estate · and if betty had remarried and then named her new spouse fred beneficiary of her rrif instead of successor annuitant fred would have the option of transferring the full amount of betty s rrif to his own rrif or a rrsp if he is under age 71 · with the rollover of betty s rrif to fred s rrif there is no immediate taxation of the rrif however the fmv fair market value the full amount of the rrif must be reported on betty s terminal tax return a deduction is available for a designated benefit paid to a survivor to offset any tax in betty s estate under the named beneficiary option some unique tax planning strategies are available to provide tax relief for fred these same strategies can be used reduce tax in betty s estate such as applying any of betty s remaining net capital losses to income a tax professional will be able to assist with these opportunities thank you from williamson road public school the williamson road website www.my-market.ca sturdy s taken up piano and glenn pushing one way out turdy gert mccurdy is back in town after a lengthy visit to the far north and as usual she has many an intriguing story to tell sturdy had been hired by a behavior consultant to take a group of 31 dental technicians up to her old stomping grounds so they could study the effect that extreme cold would have on their retinas i do not know why dental technicians would be studying that particular subject but i am just smart enough not to ask her in any event she told me over the course of a particularly tasty meal at hangover harry s bar and grill that although she was paid a handsome fee to provide her expertise she didn t really enjoy the experience all they ever wanted to do was talk about their guns she complained but i sensed there were other points of contention because she told me that although 31 tourists started out the trip with her only 17 made the return journey after further conversation she confided that of the missing 14 men 12 were still in hospital recovering from wounds inflicted after disputes with sturdy over various matters and two are simply unaccounted for she told me with an inscrutable smile on her face that she doubted they would ever be seen again and i am just smart enough to know it could be harmful for my health if i were to press the matter s so we moved on to other matters over the course of the meal she did tell me she has another love interest a cardboard salesman whose name she has forgotten but she has promised to tell me what it is the minute she recalls it the rest of the evening passed without incident except for the very end when my old pal broke three of the waiter s ribs during a heated conversation over the bill i somehow think there is no need to tell you who won that particular dispute but on the bright side i am pleased to report that the waiter is recovering quite nicely at his home where he is surrounded by loved ones oh i almost forgot that sturdy is now busy learning how to play the piano and she seems to be progressing quite nicely except for delays caused when she throws the instrument out the window because it won t strike the chord she wants so now it is time for all of us to sit back and enjoy the various divertissements available for our listening and viewing pleasure at the many public parks that bless this community unfortunately none of them will bear the unmistakable stamp of anne butler who is retiring from a long and honorable career in all the aspects of what is fondly termed show biz i shall not list her accomplishments in her chosen profession because that will be chronicled elsewhere but i do want to say on behalf of my wife jean and i that we do wish anne all the best in the years ahead and no i will not be surprised if she succumbed once again to the siren call of a profession she has graced so well for so long so long that s a pretty good exit line now that i ve a chance to take a look at it before i sign off i would like to renew my campaign for a one-way system on the sidewalks in the beach area under my plan i propose that the sidewalks on the north side of queen street from beech avenue to woodbine avenue be made one way west the south side of queen from woodbine avenue should then be declared one way to beech avenue thus creating an orderly pedestrian flow this will eliminate random bumpings though they can have their good side and it should also cut down dramatically on the number of spilled ice cream cones that are a regular but unhappy occurrence along the thoroughfare i have been pushing for this action ever since i was almost run over by a three-year-old pedalling his tricycle at what i consider a dangerous rate of speed this is just to serve notice that i have not given up my lonely campaign and i shall keep you informed of any new developments as they occur new theatre company at guild gardens cont d from page 1 buchbinder has composed new a.m to 9 p.m everyday open a glimpse into beach houses of worship by rev shelley mcvea from our earliest days it seems that we have been taught to count something one sheep two sheep three sheep our sesame street friends bert and ernie have coached us well now that i m into my middle years my counting patterns have changed somewhat two pounds lost last week gas prices are up two cents today stocks down 1/2 a percentage point fifty more dollars in my savings account yesterday i counted six slugs in my garden being a pastor has brought more counting into my life five more people were in attendance last sunday three less people this week numbers can become the barometer of how well we re doing in life measuring either the happiness or the sorrow of the day one of the ancient writers invites us to consider another counting scheme not our bank accounts or weight gained or lost or stock portfolios moses wrote teach us to count our days that we may gain a wise heart the number of seconds and minutes and hours allocated to each of us is the same no need for comparison each day is a gift not brought about by our own ingenuity or efforts but simply as a present what would our lives look like if we were to count or number our days rather than our portfolios it might mean that we take ourselves less seriously does a pound either way make a difference especially if it can ruin a day that i want to count do i really need to keep this particular quarrel going how important is it that i have the last word if i m counting my days maybe this might be the last one it might be better that i make up with that person now or maybe it means that we take ourselves more seriously maybe it is time that i take that course i m always been thinking about but i might not enjoy it it will take three years what if i m not good at it i m already counting my excuses one of my favourite movies is groundhog day actor bill murray plays a reporter who is sent with other reporters to cover the annual feb 2nd festivities in smalltown usa he is mean nasty and bored and both the townspeople and his colleagues are happy when the assignment is over but as murray wakes up the next morning he finds that he s reliving groundhog day all over again at first he believes that he s going crazy but as each morning dawns and he is assigned to relive the day again and again he gradually begins to change his attitude he saves the person that he knows is going to fall he helps people that need direction he learns his colleagues likes and dislikes he takes music lessons by the end of the movie he has redeemed his own life found love and changed the lives of many in the small town bill murray got a chance to relive one day over and over until he `got it right we aren t given that luxury but if we think that a voice from the past might have some wisdom for us let s try counting our days they are finite and precious may we number them as such and bring to each one the unique gifts and skills that we have been given enjoy the summer happy canada day and may you have a heart of wisdom rev shelley mcvea is the priest-in-charge at st saviour s anglican church at kimberley and
