alcohol had hospitalized him with a bleeding stomach ulcer several times and his mind was nearly gone he said i was close to death and beyond hope there was no hope whatsoever he said i was a habitual offender and the judge should have sent me to prison i told the judge `there s no sense putting me on probation in spite of all my good intentions i will go straight to a liquor store i thought that if i was put away for three years my habit would go away luckily for noack the judge not only gave him probation he entered him in a jail diversion program that sends nonviolent drug and alcohol city manager jim scholl told mauldin city commissioners of his decision via e-mail late wednesday and announced in the same message that he has appointed police capt donie lee as acting police chief mauldin will be paid while on leave pending the outcome of the investigation as is standard procedure lee referred all questions to city attorney shawn smith but said he did not know what agency will grace lutheran school ask their parents to stop parking in front of residential houses every day i have to park down the street and i pay $3,000 a month rent there is an entire parking lot for these parents the tdc s advertising won t change the fact that key west is even more wickedly overpriced than ever in all tourism/living aspects and the unique atmosphere that people used to come here to experience is almost gone someone is threatening to euthanize her cats in a classified ad because she is leaving the keys this is a horrible shame a great way to save time reading the morning paper is to look at the name of the guest columnist and figure out who he or she works for do we still like being called conchs the highway department needs to keep the shoulders on u.s 1 as clear as possible addictions and the unlawful behavior that accompanies seeking drugs and alcohol the judge saw that the only reason i was getting into trouble was because of my problem noack said not only is noack still alive he has been sober for more than three years he s now earning a degree to become an addictions counselor while he works with other addicts trying to recover at guidance clinic of the middle keys he attends 12-step meetings every day and holds onto his new life like a treasure now the bad news the florida legislature is asking the state department of corrections to cut $37 million from correctional sub stance abuse programs a move that will kill keys to recovery and other court drug-diversion programs in monroe county members of the house public safety and security committee and the senate criminal and civil justice appropriations committee in tallahassee were to decide by today whether to push for the cuts if they make that decision we will get a letter that they re closing our program said jamie pipher director of the guidance clinic of the middle keys which runs the keys to recovery program we could be closed in 30 days the cuts would take away $250,000 in state money a year from the program the program gets some funding from the county but not nearly enough to keep it operating it s not hard to picture what it would mean to the keys if the program closes pipher said it s good to remember that the patients or defendants however they re viewed often end up drug or alcohol-free and return to take their places in the family and community she said these people are from every income level in the county family members who are returned to productive lives pipher said after detox and rehab program residents must agree to be monitored for drug use find a job undergo counseling throughout the day and regularly attend 12-step meetings statistics show that the program is successful pipher said fifty percent of offenders who have successfully completed the program returned to the community as productive citizens with no arrests on new charges before entering the program clients had 128 total arrests in the county none of them had been arrested a year after completing the program and florida pays $55.80 a day for each patient in the program one day of incarceration in the monroe county detention center costs more than $70 pipher and others launched an effort last week to sound an alarm judges lawyers groups law enforcement agencies and the addictions recovery community have been sending press releases information packets and letters to newspapers radio and television stations state rep ron saunders dkey west has been trying to save the program in monroe county while pipher and others call and e-mail state lawmakers we have a contact list of key legislators in tallahassee pipher said we re encouraging people to contact the legislators to tell them how important this program is to the community jguerra@keysnews.com mauldin continued from descendant of capt geiger famous for his association with the audubon house he graduated from key west high school in 1939 and worked for the navy before enlisting in the u.s army in 1942 during his military career he rose from the rank of private to the rank of lieutenant colonel throughout his 21-year career he served in france during world war ii then japan from 1947 to 1949 and two tours of duty in korea during the korean war then to fort bragg n.c and returning to japan from 1954 to 1956 he then was transferred to toledo ohio where he served as the reserve training officer for toledo university he was then stationed at babenhausen germany where as a major in the artillery he served as the youngest battalion commander in a european theater while stationed in germany he was promoted to the rank of lieutenant colonel his last duty station was fort mcclellan ala after retiring from the army in 1964 lt col aguero returned to key west where he began his public service career with the city of key west first as public service director hud finance director and acting city manager he then took a position with monroe county as the first director of the municipal service district upon retiring in 1991 he continued to enjoy his many friends and the activities that he had loved from childhood particularly fishing and being with friends he was known for his excellent conch chowder tempura shrimp and key lime pie he also loved tending to his many fruit trees and roses in 1999 he and his wife relocated to john knox village in orange city charles was a loving and devoted husband ralph morrow/sports editor shirley freeman charlie bradford anti-academia act likely a formula for disaster ot every florida university needs to offer a medical degree or other costly graduate and research programs but a bill that would create a new tier of undergraduate colleges has surfaced for the worst of possible reasons it has sprung from a legislature that resents university leaders who speak out on budget cuts and that prefers instead to offer college degrees at bottom-dollar prices this is the wrong way to make higher education policy the motivations behind this undergraduate college plan are revealed by the financial climate and the legislative vehicle in which it travels the financial climate is the bleak $2.5 billion shortfall lawmakers face this year and the universities that are already being forced to reduce fall enrollment the legislative vehicle is a constitutional amendment pushed by senate president ken pruitt that also would abolish the current university board of governors a bill that might as well be labeled the anti-academia act the sad irony is that the question of whether to create different tiers of universities is longstanding and the resistance has typically come from legislators who want their favored universities to get the best in medical and law schools and research centers the new legislative proposal would skip right past that n editorial more difficult debate by involving only community colleges in the transition the frantic pace at which these higher education bills are moving through the legislature is in character with the dismissive anger that drives them the pruitt amendment would also convert the k-12 education commissioner from an appointed to an elected office in one amendment thus the legislature would be telling voters they were wrong about the education commissioner and wrong about the board of governors neither change has been in effect for longer than five years pruitt at least hasn t tried to disguise his animosity toward florida s university presidents and leaders but on wednesday all 40 senators [were scheduled to take sides in his grudge match are they too willing to treat the state s leading universities as though they are enemies of the people are they willing to throw out the board of governors and shuffle the community-college deck for the purpose of bolstering pruitt s bruised ego good decisions are seldom made in haste or anger this combines both and for higher education could spell disaster the st petersburg times letters to the editor business owner should be kinder to tourists my family and i just returned from a spectacular vacation in key west a dear friend of mine owns a home on truman avenue and had offered it to my family for the week this was our second trip to key west and i can t say enough about the residents of key west and their hospitality unfortunately my wife and i had a disturbing experience one afternoon that can t go without comment me and my family are all avid cyclists we take our bikes with us on every trip that we can my wife and i were out one day on our tandem doing a loop of the island we had discussed earlier in the week how respectful and thoughtful drivers were of cyclists in the area just before we turned off u.s 1 onto a1a a pickup passed very close to us leaving very little room and once in front of us quickly accelerated leaving us in a thick cloud of black diesel smoke i happened to catch the name on the back glass off the truck and looked it up in the phone directory when we got back to the house i called the company name on the truck hoping to speak with the owner thinking that it was an employee in the vehicle but to my dismay it was the owner driving the truck after identifying myself and explaining my disappointment with the actions of the driver of the pickup the owner of the truck told me that he remembered me and that yes he did cut in close to me and black smoked me because you people think you own the road and can disrupt traffic flow when you feel like it and yes i apologize for cutting close to you but i m glad you got a face full of black smoke that will teach you people you people would that be one of the life bloods of the community tourism does not [his business depend upon a portion of tourist business not only am i a cyclist but i enjoy fishing also now knowing the attitude of the [truck owner toward tourism i am so thankful that we chose another charter company of the two days we went out i can t imagine spending my money or time with a gentleman who thinks so lowly of the very population that lines his pockets you would think that someone who depends on tourist traffic would be more compassionate toward tourists jon todd savannah ga have shown good judgment for the county are boobs what was the point of his letter why coleman would bother to attack a concerned citizen who goes to all the [board of county commissioners planning and [development review committee meetings on her own time and expense tells me she s probably on the right track it has been jerry coleman s actions in the past listening to him speak at public meetings reading his letters to editors and what he has charged us taxpayers for his work that i have determined coleman to be a noncredible person in a time when developers the people he represents seem to get their way all the time it saddens me that coleman would try to intimidate future activists who are desperately needed to stand up against special favors to these developers we need to get more citizens involved because of people like coleman who use unfair tactics abuse rules and regulations for the benefit of developers who have money time and power as the rest of us work two to three jobs to make ends meet developers have bought up trailer parks gotten them rezoned evicted families living in these parks forcing most to leave the keys this is a work force we lose for the benefit of the developer and loss to our community developers make money off of these people s hardships this is what coleman stands for at the planning board meeting when the preservation of working waterfronts item first came up it was very late into the night with only one staff person left as coleman was arguing it left and right bay bottom never taken into consideration for land-use was then calculated into the math to determine how much density should be allowed bay bottom [that cannot be built on the density normally two units per acre was increased to 16 units per acre there also was a hotel that developers wanted to build which all of a sudden became a place for our emergency personnel to stay during hurricane evacuation this hotel was promoted as a much-needed hurricane shelter but emergency personnel already have category 5 hotels in which they stay in during these storms the benefit to developers in building a hurricane evacuation shelter is that it does not require [building allocations by the way the [proposed hotel at the key west airport also will not require [allocations so developers have their tricks lawyers like coleman and three county commissioners to push whatever they want through for this reason we need more people like kay thacker it is [jerry s gang of three who should be considered the boobs and [he can throw [himself in with that crowd diane beruldsen stock island sept 11 attacks wrenching stories of plans and dreams cut off in mid-breath there was no real connection between iraq and sept 11 until the bush administration made it so the 2,973 lives lost that day senator bill nelson s remarks thursday to the florida senate t s fitting that we come together in this city in this state for i wish to discuss an issue all too familiar to florida and sacred to our democracy the right to vote and to have that vote count as intended a year ago you passed a bill to move florida s presidential primary to an early date on the national election calendar your thinking was to give our large and diverse state a microcosm of america more of a say in the selection of the presidential nominees and we all know what happened both national parties decided to punish florida because their rules reserved early presidential contests to a handful of other states for eight months now i have been immersed in a fight to get the chairman of my party to end a stalemate to seat florida s delegates and honor the state s jan 29 primary in what was on that date a historic turnout some 3.6 million citizens headed to i the polls and cast ballots in florida s democratic and republican presidential primaries for me this issue is simple it s a case of fundamental rights versus party rules last october i sued my own party and its chairman in federal district court in december i lost that court bill nelson fight but i have guest columnist continued to push for my party to find a way to seat a delegation from florida while giving floridians a meaningful voice in the selection of their party s nominee my fight has been based on the principle that in america every citizen has an equal right to vote it is based on a premise that floridians are entitled to have their votes count as intended and it is based on a belief that we all deserve a say in picking our presidential nominees more recently i asked the national democratic party to pay for a mail-in revote but the party declined few people could agree on specifics including the candidates themselves now because we re at the point where reaching a solution is critical i am asking the party to divvy up the equivalent of half of florida s delegates from the jan 29 results this is allowed by the democratic rules and was done by the gop if nothing else this election has provided further evidence that our system is broken you and gov crist are to be commended for banning touch-screen voting machines six years after the state outlawed punch-card ballots because of the problems in the 2000 election and this year legislation has been introduced to toughen the audits of election results thank you what you have done in florida must not be an end but a beginning as to our right to vote and have that vote count there can be no debate the goal is simple one person one vote last fall i filed legislation in the u.s senate requiring that no vote for federal office be cast on a touch-screen voting machine starting in 2012 i also joined the senior senator from michigan carl levin to propose a system of six rotating primaries from march to june in each presidential election year and very soon i will file a broaderbased election-reform bill this new legislation will abolish the electoral college and give citizens direct election of their president by popular vote additionally six rotating interregional primaries will give large and small states a fair say in the nomination process the legislation will establish early voting in every state it will eliminate machines that don t produce a voting paper trail it will allow every qualified voter in every state to cast an absentee ballot if they want and it will give grants to states that develop mail-in balloting and secure internet voting i am reaching out to my colleagues in congress and to you today i respectfully ask each of you for sugges tions to make this a better bill let s not forget it was more than 230 years ago that our founding fathers declared that all men are created equal but the country still had to wait 87 years before abraham lincoln signed a proclamation freeing the slaves and it took another 57 years before women in america were allowed to vote after her arrest for voting in the presidential election of 1872 susan b anthony delivered a speech on a woman s right to vote the ballot she said is the only means of securing the blessings of liberty provided by this government even still it took another 93 years before our nation belatedly enacted a law guaranteeing every u.s citizen an equal right to vote this country cannot afford to wait that long before we fix the flaws we still see in our election system the blessings of liberty cannot wait the time for reform is now bill nelson is florida project only recently got under way during a city council meeting last month singh asked for leniency on the requirement saying the conference center would be economically beneficial to the city the council at the time rebuked the request when we were back here a month ago my major problem was there was no plan for how they were going to rectify [the affordable housing in the future vice mayor chris bull said during the meeting singh had given the council a construction schedule for the new affordable units and a list of where employees were being housed in the meantime it s my understanding that the building of affordable housing units attached to these properties is to take care of the impact that is created by these properties vasil said the fact that this company [is using other units has just further deteriorated the affordable housing inventory for other people who needed it mayor pete worthington said the community needed the economic bump that a conference center would provide and the provisional agreement would ensure the affordable housing is not forgotten i don t think it is a real big deal worthington said i don t think we need to be up here grandstanding the grandstanding comment set off both vasil and cinque i find that insulting vasil said councilwoman marilyn tempest said the agreement would serve the greater good of the city since the key west citizen friday march 28 2008 9a state tallahassee west park fort lauderdale tuition-education commissioner amendment passes senate in house next a ballot proposal that would end a legal dispute over who sets university tuition in favor of the legislature rather than an appointed board easily passed thursday in the senate the state constitutional amendment also would restore an elected education commissioner to the florida cabinet and abolish the appointed state board of education its oversight of primary and secondary schools and community colleges would revert to the governor and cabinet if the house also approves the measure it would go on the nov 4 ballot the amendment would not abolish the board of governors which administers florida s 11 state universities but would let the legislature reduce or eliminate its authority over tuition and other policy areas the board s size would also shrink if voters were to approve the change it would essentially undo what floridians did six years ago when they created the board the point was to reduce political meddling and infighting within the university system advocates said at the time board chairwoman carolyn roberts said she doesn t think voters have changed their minds since then without a strong board and unified system she said schools are likely to fight one against the other for needed funds from the legislature the legislature s relationship with the board meanwhile has been rocky especially over who has the authority to increase tuition at universities a matter they are currently fighting out in a lawsuit the amendment would make that dispute moot senate president pro tempore lisa carlton the sponsor said the legislature s tuition-setting authority is well established by existing law $100m of cocaine siezed the coast guard said it unloaded $100 million worth of cocaine at port everglades after seizing 3,200 pounds of the drug during a patrol of the western caribbean the coast guard said it state legislators writing the budget for the coming year are in a bind with tax collections in a free-fall republicans who control the legislature are staunchly opposed to raising taxes so they say cutting back on services is inevitable democrats were incensed at the proposals these are not things a civilized community does said house democratic leader dan gelber of miami beach it isn t fair it isn t right it isn t moral the deepest proposed cuts in years aren t something lawmakers want to do said rep aaron bean the chairman of the house s health care committee but they have no choice until the economy improves it s a bummer said bean rfernandina beach democrats are outraged that republicans won t consider more use of state savings or entertain any ideas for bringing in more tax dollars the senate and house are both working on budgets that include hundreds of millions in health care cuts the final versions of each chamber s budget are expected to be ready for the full house and senate to debate next week the differences in the two plans would then have to be worked out and gov charlie crist gets a say with veto power over individual items in the spending plan proposed cuts hit at a wide swath of state government programs from everglades cleanup which is completely eliminated from the house s spending plans to education where some school districts are discussing the likely need to cut sports and other extracurricular activities miami-dade schools for example have raised the possibility they will eliminate field trips and cut the number of school police or security officers both the senate and house are proposing actual reductions in the amount of per-student spending in k-12 education something that hasn t happened in nearly four decades normally when lawmakers discuss cuts to education they re talking about reducing the amount of increase in a given year but plans to cut programs in health are raising particular concerns because of the potentially painful some even say fatal results in some cases the house s proposed budget would allow nursing homes a two-year break from minimum staffing requirements to cope with a 10 percent cut in what the government pays them and with less money and no requirement to do otherwise most homes like the one where runkle works would probably quickly cut employees she said it s a for-profit company why wouldn t they runkle said reducing staff in nursing homes would be a reversal of recent improvements that advocates for the elderly have been fighting for for several years among the critics of the idea is the huge senior lobby aarp which usually carries a lot of weight in senior-laden florida aarp is appalled that the house would even consider this said aarp s florida director lori parham the idea that the house would abdicate responsibility to the industry for our most frail and vulnerable residents is unacceptable another health care initiative targeted for a cut is the area health education centers program which provides medical care in poor underserved communities like miami s little haiti and the rural farming areas of central florida often using medical students the program also has six doctors who provide primary care for more than 10,000 children in 11 inner-city miami schools the proposed $7 million cut about two-thirds of the program s budget would likely mean two of those doctors would be laid off said dr arthur fournier the director of the initiative s miami program hospitals aren t spared in the house plan the rate medicaid pays for both outpatient and inpatient treatment would be cut by 10 percent county health departments would take one of the biggest hits with the house proposing to reimburse 61 percent of what they spend instead of 100 per cent vandenhurk s first outing after florida made him its no 2 starter was a rough one vandenhurk walked five and needed 100 pitches to get through 423 innings in the marlins 2-0 loss to the st louis cardinals on thursday the right-hander allowed two runs and five hits but hurt himself with his command walking troy glaus with the bases loaded in the fifth inning a play here or a play there in that third inning and he might have been able to go deeper manager fredi gonzalez said obviously if you want to nitpick you want to cut down on the walks but i thought he did fine the marlins finalized given got on base then shelby gentes and michelle sexton had base hits lauren sanchez was walked allowing given to come home tessie worden bunted and tried to run but was tagged for the first out rozina malzacher ran in after a base hit by cortney molnar with the bases loaded andrea cockerham hit a grand slam bringing everyone home with her as if that weren t enough action for the hurricanes
